Terms of use

These terms set out the conditions for using TRACKMENTO (https://trackmento.com, “the Site”). By using the Site, you are deemed to have agreed to these terms.

Article 1 (The service)

  1. The Site is a service for laying out the thumbnails of tracks in a grid, making them into a single image and sharing it.
  2. As a rule, every feature of the Site is free and can be used without registering an account.

Article 2 (Content you enter or send)

  1. You are responsible for all content you enter or send to the Site, such as titles, notes and uploaded images (“your content”).
  2. You warrant that you hold the lawful rights to your content and that it does not infringe the rights of any third party.
  3. You permit the operator to use your content free of charge (to copy, resize and transmit it, for example) to the extent necessary to store, display and share it on the Site.

Article 3 (Prohibited conduct)

When using the Site, you must not:

  1. Act against the law or public order and morals.
  2. Infringe the copyright, portrait rights, privacy, reputation or other rights or interests of any third party.
  3. Send or share content that defames, discriminates against, intimidates or offends others.
  4. Access the Site in large volumes by automated means such as programs, or place an excessive load on the servers.
  5. Gain unauthorized access to the Site's systems or otherwise interfere with its operation.
  6. Violate the terms of use or guidelines of external services.
  7. Do anything else the operator considers inappropriate.

Article 4 (Sharing and everyone's grids)

  1. Images and share pages created with the share feature can be viewed by anyone who knows their URL.
  2. Content shared with “Add to everyone's grids” turned on appears in search results and lists within the Site.
  3. Shared content is deleted automatically 30 days after it is created.
  4. Content that violates these terms, or about which a rights holder or another party has made a legitimate complaint, may be deleted without prior notice.
  5. If you find a problematic share, please let us know through “Report inappropriate content” on the share page.

Article 5 (Rights in thumbnails and track information)

  1. Intellectual property rights in the cover images, artwork, track titles and other material shown or retrieved on the Site belong to the respective artists, music platforms or other rightful holders.
  2. The Site retrieves and displays this information through APIs and similar means provided by each external music service.
  3. When you use an image made with the Site, for example in a social media post, please follow the terms of use and guidelines of each music service.

Article 6 (Rights in the Site)

Intellectual property rights in the programs, design, logo, text and other content that make up the Site belong to the operator or other rightful holders.

Article 7 (Changes, suspension and termination)

The operator may change the content of the Site, or suspend or end the service, without prior notice to users.

Article 8 (Disclaimer)

  1. Data you are editing is kept on your device (in your browser), so it may be lost if the browser's data is cleared or because of your device's environment. Please keep your own backup of anything you need, for example with “Save layout”.
  2. The operator makes no guarantee as to the accuracy, completeness or currency of information retrieved from external services, or that images and data will remain available.
  3. The operator is not liable for any damage you suffer in connection with your use of the Site, except in cases of intent or gross negligence on the operator's part. Even where the operator is liable, compensation is limited to direct and ordinary damage you have actually suffered.

Article 9 (Advertising)

The operator may place advertisements on the Site to help cover the cost of running and maintaining it.

Article 10 (Changes to these terms)

  1. The operator may change these terms when it considers this necessary, without obtaining users' prior consent.
  2. When the terms are changed, the changes and the date they take effect will be announced on the Site in advance. By using the Site after the change, you are deemed to have agreed to the revised terms.

Article 11 (Governing law and jurisdiction)

  1. These terms are governed by the laws of Japan.
  2. Any dispute concerning the Site shall be subject to the exclusive jurisdiction, in the first instance, of the district court or summary court having jurisdiction over the operator's location.

For questions about these terms or the Site, please use the contact form. These terms were written in Japanese; if the Japanese and English versions differ, the Japanese version prevails.
